The topic of data protection is very important to us and is therefore one of our principles. Therefore, we take the protection of your personal data very seriously. This personal data will be treated confidentially in accordance with the new European General Data Protection Regulation (DSGVO) as of 25.5.2018 and this privacy policy. In the following, we inform you about which data is collected during your visit to our website and how it is used:

Information on the collection and processing of personal data

In the following we inform about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior.

Other functions and offers of our website

In addition to the purely informational use of our website, we offer various services that you can use if you are interested. For this purpose, you will usually have to provide additional personal data that we use to provide the respective service and to which the aforementioned data processing principles apply.

In some cases, we use external service providers to process your data. They have been carefully selected and commissioned by us, are bound by our instructions and are regularly inspected.

Furthermore, we may pass on your personal data to third parties, provided that you have consented to this, if promotions, competitions, contract conclusions or similar services are offered by us together with partners or companies within the UGW AG group. Legal basis of processing

Art. 6 par. 1 p. 1 lit. a DSGVO serves our company as the legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 para. S. 1 lit. b GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for compliance with tax obligations, the processing is based on Art. 6 para. S. 1 lit. c GDPR. In rare cases, the processing of personal data might become necessary to protect vital interests of the data subject or another natural person, Art. 6 para. S. 1 lit. d GDPR. Ultimately, processing operations could also be based on Art. 6 para. S. 1 lit. f DSGVO are based. Processing operations not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject are not overridden.

Data sharing

Your personal data will not be transferred to third parties for purposes other than those listed below. We will only share your personal information with third parties if:

  • You can use your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO have given express consent to this,
  • the disclosure according to Art. 6 para. 1 p. 1 lit. f DSGVO is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data,
  • in the event that for the transfer according to Art. 6 para. 1 p. 1 lit. c DSGVO a legal obligation exists, as well as
  • this is legally permissible and in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO is necessary for the processing of contractual relationships with you.

Data subject rights

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 DSGVO to immediately demand the correction of incorrect or completion of your personal data stored by us;
  • pursuant to Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  • according to Art. 7 par. 3 DSGVO to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing that was based on this consent for the future, and
  • pursuant to Art. 77 DSGVO, you have the right to complain to a supervisory authority, without prejudice to any other administrative or judicial remedy. As a rule, you can contact the supervisory authority of your usual place of residence or place of work or the place of the alleged infringement for this purpose if the data subject believes that the processing of personal data concerning him or her violates the EU General Data Protection Regulation (GDPR).

Right to information, right to rectification, blocking, deletion, objection

Upon written request, we will inform you about the personal data stored by us. You also have a right to rectification, blocking, opposition or deletion of this data. The request should be sent to our address given in the imprint of the website or by e-mail to datenschutz@ugw.de.

Right of withdrawal

If your personal data is processed on the basis of legitimate interests, you have the right to object to the processing of your personal data in accordance with Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection, which will be implemented by me without specifying a particular situation. General collection of data

When you access our website or retrieve a file, data about this process is stored in a log file on our web server. In detail, the following data can be stored:

  • IP address (if possible, this is stored anonymously)
  • Domain name of the website you came from
  • Names of the retrieved files
  • Date and time of a retrieval
  • Name of your Internet Service Provider
  • and, if applicable, the operating system and browser version of your terminal device.

We only store IP addresses for data security reasons to ensure the stability and security of our system (legal basis: Art. 6 para. 1 lit. f DSGVO). The statistical evaluation of anonymized data records is reserved.

Cookies

Our website uses cookies. A cookie is a text file that is created when a user visits a website and is temporarily stored on the website user’s system. If the server of our website is called up again by the user of the website, the browser of the user of the website sends the previously received cookie back to the server. The server can evaluate the information obtained through this procedure. Cookies can be used, for example, to control advertising or to make it easier to navigate a website. Contact forms

If you send us inquiries, requests, questions or comments via the contact form, your data from the inquiry form, including the contact information you provide there, will be stored and processed by us for the purpose of processing the inquiry and in case of follow-up questions. Your data will be used exclusively for the purpose of answering and processing your question. The data processing is carried out here according to Art. 6 para. 1 p. 1 lit. a DSGVO on the basis of your voluntarily given consent. You can object to this at any time (right of revocation).

Job newsletter via MailChimp

If you would like to receive the job newsletter offered on our website, register on our website. The only mandatory data for sending the newsletter is your e-mail address. The provision of further, separately marked data is voluntary and will be used to address you personally. After your confirmation, we store your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a GDPR. For the registration to our newsletter we use the so-called double-opt-in procedure. This means that after your registration, we will send you an e-mail to the e-mail address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and times of registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data. You can unsubscribe from the newsletter at any time free of charge via the link provided in the newsletter. We have concluded a contract with our email service provider MailChimp on the procedure for commissioned data processing. This ensures that our service provider adheres to the strict requirements of German data protection law in all respects when sending out the job newsletter.

The job newsletters are sent via “MailChimp”, a newsletter distribution platform of the US provider Rocket Science Group. The e-mail addresses of our Job Newsletter recipients, as well as their other data described in the context of this notice, are stored on MailChimp’s servers in the USA. On our behalf, MailChimp uses this information to send and evaluate the job newsletters. Likewise, according to its own information, MailChimp may use this data to optimize and/or improve its own services. For example, for the technical optimization of the dispatch, the presentation of the newsletter or for economic purposes. The latter to determine which countries the recipients come from. Furthermore, MailChimp does not use the data of our job newsletter recipients to write to them independently or to transmit it to third parties.

UGW AG trusts in the reliability and IT security as well as data security of MailChimp. MailChimp is committed to complying with EU data protection regulations. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and specifically not to pass it on to third parties. The job newsletters contain a pixel-sized file that is retrieved from MailChimp’s server when the job newsletter is opened. In the course of this, technical information (browser used, system, IP address and time) of the retrieval is first collected. This is used for the technical improvement of the services based on the technical data, the target groups or your reading behavior based on their retrieval locations (determined by the IP address) or the access times.
Also included in the statistical collection is the determination of whether job newsletters are opened, when they are opened, and which links are clicked. For technical reasons, this information can indeed be assigned to individual Job Newsletter recipients. However, it contradicts our efforts, furthermore those of MailChimp, to monitor individual recipients. The analyses serve the purpose of identifying the reading habits of our recipients or adapting our job content to our recipients

The following information explains the contents of our Job Newsletter and the registration, dispatch and statistical evaluation process, as well as your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described. Job newsletters are only sent with the consent of the recipients or legal permission. If the contents of the newsletter are specifically described in the course of registration, these are decisive for the user’s consent. Our job newsletters contain information on permanent positions within UGW AG.

Right to complain to a supervisory authority

Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her residence, place of work or the place of the alleged infringement, if the data subject considers that the processing of personal data relating to him or her infringes the EU General Data Protection Regulation (GDPR).

You have the right to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format.

Confidentiality of your customer access

If you have been given access to a restricted area on our website that is secured by a password, you are responsible for keeping that password confidential. We ask you not to share the password with anyone.

Google Remarketing via Double Click

We use the remarketing function of the company Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). This function is used to show interest-based advertisements to website visitors as part of the Google advertising network Double Click. The browser of the website visitor stores cookies for this purpose; these cookies make it possible to recognize the visitor when he or she visits websites that belong to Google’s advertising network. We use the advertising program Google AdWords with visitor analysis of the company Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). When you click on an ad placed via the Google advertising program, a cookie is placed on your computer. Google Ads Remarketing

This is a remarketing service. By means of remarketing, the user can display interest-based advertisements to users of the website on other websites within the Google display network (e.g. in Google search or on YouTube).
